Subject: What happens next in your divorce, start to finish Margaret, You asked a fair question, and it deserves a straight answer: what actually happens now, and how long it takes. Here is the whole road. 1. Filing and first papers. We file the petition and the court opens your case. The moment the petition is filed, an Automatic Temporary Injunction takes effect by law for both spouses, freezing property, insurance, accounts, and the children's schools. We will send you a plain-language copy of what it restrains. 2. The response window. After Richard is served, the law gives them twenty (20) days [VERIFY: 12 O.S. 2012 to respond. Nothing is stalled during this window. 3. Temporary orders, if needed. If bills, the house, parenting time, or support need rules before the case ends, we ask the court for temporary orders. 4. The information exchange. Both sides put their cards on the table: income, accounts, property, debts. 5. The quiet middle. Quiet does not mean nothing is happening. Every update from us tells you what happened, what it means for you, and the next date. 6. Negotiation and mediation. Most divorces end by agreement, not by trial. 7. Trial, only if needed. If agreement fails on any issue, the judge decides it. 8. The decree. The signed decree ends the marriage and sets the terms. With minor children, Oklahoma imposes a ninety (90) day waiting period from filing before a decree can enter, waivable in limited circumstances. [VERIFY: 43 O.S. 107.1 9. After the decree. Ninety days after it is entered, we run a completion review on our own initiative and send you that report without asking. As of today, the next date you will hear from us is needs: next_date.
